・特定技能制度における地域の共生施策に関する連携
１．趣旨
令和６年３月２９日の閣議決定により、「特定技能」の対象分野を１２分野から１６分野に拡大するとともに、１号特定技能外国人の向こう５年間の受入れ見込数を約３４万５千人から８２万人に再設定しました。その際、今後、特定技能外国人のより一層の増加が見込まれることを踏まえ、特定技能所属機関が地域における外国人との共生社会の実現のため寄与する責務があること及び１号特定技能外国人に対する支援は地域の外国人との共生に係る取組を踏まえて行うことが「特定技能の在留資格に係る制度の運用に関する基本方針」（平成３０年１２月２５日閣議決定。令和６年３月２９日一部変更）に明記されました。
これを踏まえ、特定技能雇用契約及び一号特定技能外国人支援計画の基準等を定める省令の一部を改正する省令及び出入国管理及び難民認定法施行規則の一部を改正する省令では、特定技能所属機関は、地方公共団体から、共生社会の実現のために実施する施策（以下「共生施策」という。）に対する協力を要請されたときは、当該要請に応じ、必要な協力をすることを、特定技能所属機関の基準として規定することとしました。また、１号特定技能外国人支援計画（以下「支援計画」という。）の基準として、支援計画の作成・実施に当たっては、地方公共団体が実施する共生施策を踏まえることも規定することとしました。
２．概要
協力確認書の提出
・特定技能所属機関は、次のいずれかの時点において、市区町村に対し、特定技能外国人の受入れに当たり、当該外国人が活動する事業所の所在地及び住居地が属する地方公共団体から、共生施策に対する協力を求められた場合には、当該要請に応じ、必要な協力をする旨の「協力確認書」を提出する必要があります。
＜協力確認書の提出が必要な時点＞
協力確認書は、受け入れる（又は受け入れている）特定技能外国人が活動する事業所の所在地及び住居地が属する市区町村のそれぞれに提出する必要があります（両者が同一の市区町村である場合は、当該市区町村に対して一通提出します。）。
在留諸申請における申告
・特定技能外国人に係る在留諸申請において、特定技能所属機関は、当該外国人が活動する事業所の所在地及び住居地が属する地方公共団体（都道府県及び市区町村）が実施する共生施策について必要な協力をすることとしている旨を申告します。
１号特定技能外国人支援計画の作成・実施
・特定技能所属機関は、支援計画の作成・実施において、地方公共団体において実施する共生施策を確認し、これを踏まえた支援計画を作成の上、当該支援を適切に実施しなければなりません。
なお、共生施策の確認は、基本的に各地方公共団体のホームページの閲覧によって行うことを想定しています。
地方公共団体からの協力要請への対応
・本件取組における地方公共団体が実施する共生施策とは、例えば、各種行政サービス、交通・ゴミ出しのルール、医療・公衆衛生や防災訓練・災害対応、地域イベント、日本語教室等に関する施策等を想定しています。
特定技能所属機関は、地方公共団体から共生施策に係る協力を求められれば、それが共生社会の実現に必要な施策であり、特定技能外国人に対する支援に資するものである場合、協力していただくこととなります。

・Collaboration on regional coexistence measures under the Specified Skilled Worker System
１．Purpose
・A Cabinet decision on March 29, 2024 expanded the fields eligible for “Specified Skilled Worker” status from 12 to 16, and reset the expected number of Type 1 Specified Skilled Workers to be accepted over the next five years from approximately 345,000 to 820,000. At that time, in light of the expected further increase in the number of Specified Skilled Workers in the future, the “Basic Policy on the Operation of the System Relating to the Specified Skilled Worker Residence Status” (Cabinet decision on December 25, 2018; partial amendment on March 29, 2024) clearly stated that specified skilled work organizations have a responsibility to contribute to the realization of a society in which foreigners in the local community can coexist, and that support for Type 1 Specified Skilled Workers will be provided in accordance with efforts to coexist with foreigners in the local community.
Based on this, the Ministerial Ordinance Partially Amending the Ministerial Ordinance Prescribing the Standards for Specified Skilled Worker Employment Contracts and Support Plans for Type 1 Specified Skilled Workers and the Ministerial Ordinance Partially Amending the Regulations for Enforcement of the Immigration Control and Refugee Recognition Act stipulate that, when a specified skills organization is requested by a local government to cooperate with measures implemented to realize a symbiotic society (hereinafter referred to as “symbiotic measures”), it must respond to the request and provide the necessary cooperation as a standard for specified skills organizations. In addition, the Ministerial Ordinance also stipulates that, as a standard for the Support Plans for Type 1 Specified Skilled Workers (hereinafter referred to as “Support Plans”), the support plans must take into account the symbiotic measures implemented by local governments when creating and implementing them.
２．Overview
Submission of cooperation confirmation letter
・If, at any of the following times, a specified skills organization is requested by the local government where the specified skills organization accepts a foreign national with a specific skill to cooperate in coexistence measures, the organization must respond to the request and submit a “Letter of Confirmation of Cooperation” to the local government stating that it will provide the necessary cooperation.
<When the Letter of Cooperation must be submitted>
The Letter of Confirmation of Cooperation must be submitted to both the city, ward, town or village where the business establishment where the accepting (or currently accepting) specified skilled foreign national is active and where the foreign national resides (if both are in the same city, ward, town or village, one copy should be submitted to that city, ward, town or village).
Declarations for various residence applications
・In the various residence applications for specified skilled foreign nationals, the organization to which the specified skilled foreign national belongs declares that it will provide necessary cooperation for the coexistence measures implemented by the local government (prefecture or city, town or village) where the foreign national’s place of business and residence is located.
Creation and implementation of a support plan for Type 1 specified skilled foreign workers
・When creating and implementing support plans, specific skill organizations must confirm the coexistence measures being implemented by local governments, create support plans based on these measures, and then implement the support appropriately.
It is expected that confirmation of coexistence measures will primarily be done by visiting the websites of each local government.
Responding to requests for cooperation from local government
・The coexistence measures that local governments undertake in this initiative are expected to include, for example, measures related to various administrative services, rules for transportation and garbage disposal, medical care and public health, disaster prevention drills and disaster response, local events, and Japanese language classes.
If a local government requests cooperation from a specific skilled worker institution regarding coexistence measures, the institution will cooperate if the measures are necessary to realize a coexistence society and contribute to supporting specific skilled workers.
